Wet Area Waterproofing Failures: What Goes Wrong and Who Is Liable

Wet area waterproofing failures is one of the most common building defects in Australia – and one of the most expensive to fix after the fact. A failed shower membrane or a cracked sealant bead at a floor-to-wall junction might seem minor, but water that finds its way behind tiles doesn’t stay there. It tracks into wall cavities, subfloors, and structural framing, causing damage that’s often invisible for months before it becomes impossible to ignore. By then, the repair cost is rarely just the cost of resealing.

What Causes Wet Area Waterproofing Failure?

Most wet area waterproofing failures in Australian residential and commercial buildings trace back to one or more of the following:

  • Wrong or missing membrane – a shower that was tiled without a proper waterproofing membrane applied first, or with a membrane that doesn’t comply with AS 4858
  • Failed movement joints – grout used at floor-to-wall junctions instead of flexible sealant, which AS 3740 requires. Grout cracks under movement; sealant doesn’t.
  • Poor installation – membrane applied to a wet substrate, insufficient thickness, pinholes, or inadequate coverage at corners and penetrations
  • Failed sealant – the silicone bead around shower bases, bath edges, and basin junctions deteriorates over time. Once it cracks or pulls away, water enters the wall
  • Penetrations not sealed – shower rose, tap holes, and drain connections are common weak points where the membrane or sealant was not properly detailed

In most cases, the failure isn’t dramatic. It’s a small gap, a cracked bead, or a thin patch of membrane that allows a slow trickle of water into the structure every time someone showers. Over months and years, that’s significant.

How Do You Know If You Have a Waterproofing Failure?

The signs range from subtle to obvious. Early warning signs include:

  • Grout or tiles becoming loose in the shower recess or around the bath
  • Silicone sealant pulling away from tiles, fixtures, or the shower base
  • Musty smell in the bathroom, particularly in the wall cavity behind the shower
  • Soft or spongy flooring adjacent to the shower or bath
  • Water staining or damp patches on the ceiling of the room below
  • Mould growth on the wall surface around the shower that keeps returning after cleaning

Any of these signs warrants investigation. The worst thing to do is retile over an existing shower without addressing the waterproofing underneath – a common and costly mistake that stores the problem rather than fixing it.

Who Is Liable for Wet Area Waterproofing Failures?

Liability for waterproofing failures in Australia depends on when the failure occurred and who installed the work. Under the Home Building Act in NSW and equivalent legislation in QLD and VIC, residential building work is subject to statutory warranties. Waterproofing defects that become apparent within the statutory defect liability period are the builder’s responsibility to rectify, even after handover.

For work outside the warranty period, or in strata buildings where common property is involved, the situation is more complex. A waterproofing failure in a strata building that causes water damage to the lot below involves the owners corporation, the lot owner, the original builder, and potentially the licensed waterproofer – and the liability question often requires legal advice to resolve.

What Does a Proper Wet Area Waterproofing Repair Look Like?

If waterproofing has failed, the correct fix depends on the extent of the damage. For isolated sealant failure at movement joints – the shower base perimeter, floor-to-wall junction, around the bath – a professional reseal using the correct neutral cure silicone product is often sufficient, provided the substrate underneath is dry and structurally sound.

Where the membrane has failed or water has tracked into the wall cavity, the repair is more involved. Tiles may need to come off, the substrate dried out, and new membrane applied before retiling. Attempting to seal over a wet or compromised substrate delays the problem – it doesn’t fix it.

Preventing Wet Area Waterproofing Failures in New Construction

For builders and developers, the best protection against waterproofing liability is doing it right the first time. That means correct membrane selection and installation to AS 4858, flexible sealant at all movement joints as required by AS 3740, proper detailing at penetrations and corners, and engaging a specialist sealing contractor for the wet area work rather than leaving it to whoever is cheapest on the day.

A wet area that’s sealed correctly on a new build might never need professional attention for 10-15 years. One that wasn’t done properly can be causing problems within 12 months of handover.
